Judge sides with UVa in climate case, dismissing Cuccinelli demands
Cuccinelli,  a vocal climate change skeptic, had been investigating the possibility  that climatology professor Michael Mann fraudulently obtained five  taxpayer-funded research grants while employed at UVa between 1999 and  2005.
[...] In his ruling, Peatross set aside Cuccinelli’s civil  investigative demands “in their entirety, without prejudice to the  Commonwealth to proceed according to the law.”
Cuccinelli did not  show, Peatross wrote, any evidence that Mann’s work was “misleading,  false or fraudulent in obtaining funds from the Commonwealth of  Virginia.”
[...] Cuccinelli said in a statement that he will send a  new CID to UVa to continue his hunt for proof that Mann defrauded  Virginia’s taxpayers in obtaining grants that funded his climate change  research.
“While this was not an outright ruling in our favor, I am  pleased that the judge has agreed with my office on several key legal  points and has given us a framework for issuing a new civil  investigative demand to get the information necessary to continue our  investigation into whether or not fraud has been committed against the  commonwealth,” Cuccinelli said.
A UVa spokeswoman said a statement on Peatross’ ruling will be forthcoming.
Mann, who now works at Penn State, said he is “very pleased” the judge set aside Cuccinelli’s subpoenas.

I  would have thought Mann would be anxious to have his name cleared by an  investigation. Does he have something(s) to hide? The ruling doesn't  answer the question and reduces the accountability of institutions  funded by the public purse.

Carbon Dioxide Riches Disappear. [US 5 cents/ton]
[...]  Putting aside the United Nations’ never-ending effort to exert  authority  over all the nations and all the peoples of the world, global  warming  was about an audacious scheme to monetize carbon dioxide; to  sell  “carbon credits” and, by doing so, enrich those who were behind  the  scheme. 
Recently, Patrick Henningsen, the editor of 21st Century Wire, penned a commentary, “The Great Collapse of the Chicago Climate Exchange”,   an excellent analysis of how the bottom fell out of the scheme to buy,   sell, and trade “carbon credits” based on the fraudulent claim that   “greenhouse gas emissions” had to be reduced worldwide to avoid global   warming.
Henningsen noted that Reuters had reported that the   Intercontinental Exchange, Inc, the operating body of the Chicago   Climate Exchange (CCX),  “will be scaling back major operations (in  August), a move that  includes massive layoffs. This is likely due to the  complete market  free-fall of their only product…carbon emissions.” In  May and June  2008, the carbon credits were trading at $5.58 and $7.78  respectively”  until it finally dawned on investors that they were  utterly worthless.
“Unlike  most real markets,” wrote Henningsen,  “the carbon market was created  by banks and governments so that new  investment opportunities could  seamlessly dovetail with specific  government policies. It’s a fantasy  casino based on a doctrine of pure  science fiction.”

Killing Biofuels
[...]  even the US Congress is incapable of turning corn ethanol into a   positive proposition. Investigations by the US EPA, the California Air   Resources Board (CARB) and the EU's joint Research Council all reported   that biofuels pollute more than the fossil fuels they are supposed to   replace, leading researchers to conclude that it would be better to   simply burn the crops rather than convert them to biofuels. Add to that excessive water use in creating biofuels and the green luster of these fuels fades significantly.

[...]  Clearly, there are way too many ulterior motives involved in the debate  over possible CO2-induced climate change and what to do about it. So  what is our solution? Let simple facts prevail, realizing that one of  those facts is that there simply is not enough freshwater on the face of  the earth to make the production of biofuels a viable and significant  alternative to the mining and usage of fossil fuels.

Will wind farms pick up the tab for new nuclear?
Wind  farm developers fear National Grid proposals designed to accommodate  nuclear power plants will lead to a huge increase in backup costs
National  Grid released a consultation document in June detailing how the  proposed development of six nuclear power stations would require the  grid operator to increase the amount of backup power, known as "spinning  reserve", that it has available to call on in the event of a large  power plant failing, from 1,320MW to 1,800MW.
The company estimated  that as a result, the annual cost of providing so-called Large Loss  Response will rise from £160m a year to £319m.
The consultation  looked at a number of approaches to charging energy firms to cover the  increased cost, but in a letter to Ofgem National Grid commercial  director for transmission Alison Kay said the company had decided to  retain the current regime, whereby generators are charged an equal  amount per megawatt they provide to the grid.
Wind farm operators are  known to be furious at the decision, which they claim will see them  face an unfair doubling in charges from National Grid, despite the fact  the company concluded in its consultation that generators with less than  350MW of capacity, including all operational wind farms in the UK,  "pose no additional loss risk to the system".

Texas Response to EPA "Tailoring Rule" for Greenhouse Gas Regulation

Dear Administrators Jackson and Armendariz,
In  order to deter challenges to your plan for centralized control of  industrial development through the issuance of permits for greenhouse  gases, you have called upson each state to declare its alligence to the  Environmental Protection Agency's recently enacted greeenhouse gas  regulations - regulations that are plainly contrary to United State Law.  75 Fed. Reg. 31,514, 31,525 & 31,582 (June 3, 2010) (herinafter,  the "Tailoring Rule"). To encourage acquiescence with your unsupported  findings you threaten to usurp state enforment authority and to  federalize the permitting program of any state that fails to pledge  their fealty to the Environmental Protection Agency (EPA).
On behalf  of the State of Texas, we write to inform you that Texas has neither the  authority nor the intention of interpreting, ignoring, or amending its  laws in order to compel the permitting of greenhouse gas emissions.

“Ozone  values dropped, to reach a minimum of around 125 DU (60% depletion) in  late September, (Antarctic spring). The lowest daily value measured was  107 DU on October 1. This minimum value is similar to those recorded  each October since the early 1990s.”
It is also similar to those in  the spring of 1958 at the French Antarctic Observatory at Dumont  d'Urville [opposite side of the South Pole from Halley Bay], when Rigaud  and Leroy [quoted in Annales Geophysicae (November, 1990)] reported  atmospheric ozone levels as low as 110 DU.

Has  the AGW by CO2 scam become too big to fail? The media could sack or gag  the alarmists for as  long as the realists have been gagged. Better still, the public could  stop buying rags that use and promote alarm to sell copy.
